TERMS AND CONDITIONS FOR LIVE IN PERSON AUCTIONS - SEE BELOW FOR ONLINE AUCTION TERMS AND CONDITIONS
- 1. You must register with our auction company in order to bid and buy. You will need a valid driver's license to register.
- 2. All purchases must be paid for on auction day within one hour after auction has ended.
- 3. We accept payment by cash or check. We do not accept credit or debit cards at this time. If paying by check, you must have a letter from your bank on the bank letterhead that will need to verify that you are in good standing and maintain a good account at all times.
- 4. All items sell as is. There are no guarantees or warranties on any items you purchase. It is up to you the bidder / buyer to inspect any item of interest before bidding begins and to determine what the condition and value of each item is.
- 5. If buying for farm use, you need a valid farm exempt certificate. Remember not all items can be farm used. We have a sheet of paper from the state comptroller that we go by.
- 6. If buying for resale, you need a valid resale certificate with you.
- 7. We are acting as an agent for the seller only. Any warrantees or guarantees made by the seller to you will be between you and the seller only.
- 8. All auctions are considered with reserve unless advertised as absolute in which all items will then sell regardless of price.
- On reserve auctions the seller or their agent reserve the right to bid in order to get the final price the seller wants.
- 9. Announcements made on auction day supersede all other verbal and written agreements.
- 10. We will load out on auction day until 4:00pm and on Monday 9:00am to 4:00pm. We are closed on Sundays. There will be no loading out until you have paid for all your purchases.

- This is an as is auction and you accept and agree to all terms of our auctions upon registering to bid and buy.
- You have to pre-register to participate in this auction.
- We have to approve each bidder, so we recommend registering as soon as possible to be approved to participate in the auction.
- All items are being sold as is. There are no guarantees or warranties.
- You can preview items on preview day(s) and look at and inspect items and use your own judgement as to the condition and value of each item. (See Preview Times on HiBid Page)
- CLC Auction Services make no guarantees on any items in any of our auctions. It is solely up to you the bidder/buyer to look at all items and to use your own judgement as to the condition and value of said items.
- Your bid is a binding contract. No bids can be retracted. No refunds will be given on any item you bid on and win.
- All purchases must be paid for before 2:00PM the following day after auction closes. No Exceptions See the payment terms for types of payments accepted for this auction. If items have not been paid for before 2:00PM the following day, we will charge the credit card on file.
- Online Auctions, we will accept cash, cashier's check, or a personal or business check. If paying by personal or business check, you must have a letter from your bank that verifies check to be good, or we will not accept check. We will also accept Venmo.
- We do not ship any items. All items must be picked up in person. All items must be picked up on the pick-up day(s) and time given. See HiBid for pick up times. If you cannot pick up on that day, then do not bid on this auction.
- Bring your own help to load your purchases. A lift will be on site to help load non running tractors and some heavier large items.
- CLC Auction and seller are not responsible for any damages or accidents that may occur during load out.
- CLC Auction Services and the seller(s) are not responsible for any accidents or injuries while on the property of estate.
- You are responsible for yourself and anyone you bring with you. You are responsible for the cost of any damages you may cause while on the estate property.
- There will be no smoking allowed on the premises. No exceptions.
- No animals allowed on the premises.
- Sales tax will be collected on all items unless, if buying for agriculture use, you must have an agriculture use exemption number on file when you register to bid otherwise you will pay sales tax. Not all items are considered agriculture use and therefore sales tax will be collected on those items.
- If buying for resale you must have a copy of your resale certificate on file when you register to bid otherwise you will pay sales tax.
- There will be no refunds if you do not have certificates on file prior to bidding.

- Online Auctions, there will be a 15% BP (Buyer's Premium) added to your final purchase price. Sales tax will be added to the final total.
- CLC Auction is not responsible for any internet or power outages or any other problems that may occur / happen during this auction that may cause you difficulty or the ability to bid while bidding or taking part in all of our auctions. CLC is not responsible if for any reason you are not able to bid on or miss any lots that you are attempting to bid on.
- There are no exceptions to our terms, conditions and rules. You agree to all our terms, conditions and rules when registering to bid.
